1. About Zamá Charters

Zamá Charters is a private yacht charter booking agency operated by Cristian Ortiz Suárez, a Swedish-registered sole trader (enskild firma, Sweden). Zamá Charters acts exclusively as a booking agent and commercial intermediary between clients and independently licensed vessel operators in Cancún, México.

Agency Status: Zamá Charters does not own, operate, or crew any vessel. All maritime operations — including navigation, safety management, and onboard service — are conducted by independent licensed operators in Cancún who hold the required Mexican maritime authorisations (SEMAR/CONAPESCA). By completing a booking, the client acknowledges that Zamá Charters acts solely as agent and facilitator, and that the charter service contract is between the client and the independent operator.

Insurance: The vessel operator carries passenger liability insurance covering all guests during charter operations. Zamá Charters, as booking agent, is not a party to that insurance contract. Clients are encouraged to purchase travel insurance for their trip.

Limitation of Liability: Zamá Charters is responsible for booking coordination, deposit collection, pre-trip communication, and concierge services. Zamá Charters is not liable for the performance, conduct, or safety standards of the vessel operator, nor for any personal injury, property damage, or loss arising from the charter service itself. Zamá Charters' maximum liability to any client is limited to the deposit amount paid.

2. Booking & Payment

How Booking Works

All bookings are made through zamacharters.com/booking.html or by direct communication via WhatsApp or email. A booking is not confirmed until Zamá Charters has sent a written confirmation and the deposit has been received.

Payments are processed securely via Stripe. We accept all major credit and debit cards including Visa, Mastercard, and American Express. All prices are in US Dollars (USD).

Pricing

Prices displayed on zamacharters.com are subject to change without notice. The price confirmed in your booking confirmation is the binding price for your charter. Add-ons requested after confirmation are subject to availability and current pricing.

3. Cancellation Policy

Summary: Free cancellation up to 7 days before. 50% refund between 2–7 days. No refund within 48 hours. Weather cancellations by captain = full refund always.

How to Cancel

Cancellations must be submitted in writing by email to [email protected] or by WhatsApp to +46 76 420 07 44. The cancellation date is the date Zamá Charters acknowledges receipt of your cancellation in writing.

Rescheduling

You may reschedule your charter once at no charge if requested 7 or more days before your original departure date, subject to availability. Rescheduling within 7 days of departure is treated as a cancellation under the policy above.

4. Weather & Captain's Discretion

The safety of guests and crew is the highest priority. The captain has final authority over all decisions regarding departure, route, and early return based on sea conditions, weather, and any circumstances that may affect safety.

Captain-Called Cancellation

If the captain determines that conditions are unsafe for departure or continued sailing, the charter will be cancelled or cut short. In this case, clients will receive:

The client's choice between refund and reschedule will be honored in all cases of captain-called cancellation.

What Does Not Constitute a Weather Cancellation

Light rain, minor cloudiness, afternoon wind (below 20 knots), or brief showers do not constitute unsafe conditions. The captain may adjust the route to provide the best possible experience under variable conditions. These adjustments do not entitle clients to a refund or reschedule.

Client-Requested Cancellation Due to Weather Concerns

If a client chooses to cancel due to weather concerns that the captain does not consider unsafe, the standard cancellation policy (Section 3) applies.

5. Guest Conduct & Age Policy

Minimum Age

Guests under 18 must be accompanied by a parent or legal guardian at all times. There is no minimum age for the charter, but children must wear life jackets while on deck whenever the vessel is underway. Life jackets in children's sizes are provided.

Guest Conduct

Guests are expected to behave in a manner that is safe and respectful of crew, fellow guests, and the vessel. The captain has the right to refuse boarding or remove any guest who is:

In any of the above cases, no refund will be issued for the removed guest(s). The charter may proceed for remaining guests at the captain's discretion.

Alcohol Policy

Alcohol consumption is permitted on board within reason. Zamá Charters and the vessel operator reserve the right to limit or stop alcohol service at any time in the interest of safety. Guests are responsible for their own conduct regardless of alcohol consumption.

Smoking

Smoking and vaping are not permitted inside the cabin or below deck. Smoking on the stern deck is permitted only with crew awareness and in a designated area. Cigarette disposal must not be into the water.

6. Liability & Risk

Nature of Activity

Boating, swimming, snorkeling, and water sports carry inherent risks including but not limited to: sea conditions, marine life, sunburn, dehydration, falls, and equipment malfunction. By booking a charter, you acknowledge these inherent risks and accept them voluntarily.

Limitation of Liability

Zamá Charters, acting as a booking agent, is not liable for:

The total liability of Zamá Charters shall not exceed the total amount paid by the client for the specific charter in question.

Vessel Operator Liability

The licensed vessel operator maintains their own insurance and is responsible for the safety and operation of the vessel. Clients may have direct claims against the vessel operator for matters arising from vessel operation.

Personal Property

Zamá Charters and the vessel operator are not responsible for loss, theft, or damage to personal belongings brought on board. Clients are advised to leave valuables at their hotel and bring a dry bag for electronics and documents.

7. Health & Safety

By booking a charter, you confirm that all members of your group are physically capable of participating in the activities booked. Please inform us in advance of any medical conditions, physical limitations, or disabilities that may affect your participation or require accommodation.

Zamá Charters and the vessel operator are not responsible for medical emergencies arising from undisclosed health conditions.

Reef-safe sunscreen is strongly recommended and may be required at certain snorkel locations in accordance with local environmental regulations. Clients are responsible for compliance with local environmental laws.

8. Disputes & Governing Law

These Terms & Conditions are governed by the laws of Sweden. Any disputes arising under these terms shall first be addressed through direct negotiation. If unresolved, disputes shall be submitted to the courts of Göteborg, Sweden, which shall have exclusive jurisdiction.

For US-based clients, nothing in these terms removes any statutory rights you may have under applicable consumer protection laws.

9. Changes to These Terms

Zamá Charters reserves the right to update these Terms & Conditions at any time. Changes will be posted on this page with an updated date. Bookings confirmed before any change are governed by the terms in effect at the time of confirmation.
